Goijman appeals Volleygate verdict

Mario Goijman continues his fight against FIVB president, Ruben Acosta. He has now appealed the the Swiss court's decision to clear Ruben Acosta and chief financial controller Franz Schmied of charges of intentionally decieving the FIVB Congress by falsifying the auditor’s report for the year 2000.

The appeal is based on several actions taken by judge Michel Carrard which appear strange to Mario Goijman and his Swiss laywers:

  • Firstly, the judge refused to hear any witnesses proposed by Mario Goijman

  • Secondly, the judge came to the conclusion that a falsification had taken place but that it was not a crime

  • Thirdly, the judge ordered Ruben Acosta and Franz Schmied to pay the costs of the case even if he had found them not guilty

  • Fourthly, the judge gave very little consideration to the fact that the FIVB accounts did not provide FIVB members with an accurate picture of FIVB's income and expenses

Mario Goijman has already spent significant amounts of his personal funds on bringing the case to trial but in a press release he says that he is determined to continue his fight for transparency, democracy, honesty and dignity in international volleyball.

Mario Goijman already has a scheduled appointment with the Swiss court system in May this year. He wants the help of the civil court to annull the decisions taken by the FIVB to remove him from the FIVB Board of Adminstration and to expell him from volleyball at national, continental and world level.
